Technicality Allows Release of Suspect
A technicality allowed the release of a suspect charged with more than 100 child pornography counts, but he still faces a trial on those charges. A status hearing is slated for November 13, 2015.
Shane Paul Jeansonne, 27, a resident at 84 Motel, just west of Jena, LA, was taken into custody about 10 PM, March 18, 2014, after investigators with the Louisiana Attorney General’s Office served a search warrant on the suspect.
Jeansonne was being held at the LaSalle Correctional Center in Urania, LA, with bond set $750,000. Jeansonne was ordered released from custody because an affidavit for probable cause was not filed within 48 hours of his arrest by the Attorney General’s Office.
The law requires that if a person is arrested without a warrant, as was done in this case, an affidavit establishing probable cause must be presented to a magistrate within 48 hours of that arrest. If this is not done, the person must be released, but the charges remain.
Jeansonne has been arraigned in 28th Judicial District Court and his case is proceeding, according to District Attorney J. Reed Walters. “His status conference is set for November and if he doesn’t plead then, he will be set for trial,” Walters said. “I’ve discussed this with the AG’s office and steps are being taken to make certain this doesn’t happen again. I believe this was a mistake in believing that the booking process was all that was needed.”
A story appearing in this newspaper shortly after Jeansonne’s arrest noted that an investigation by the AG’s Cyber Crime Unit, which targets distribution and possession of child pornography, determined that Jeansonne was apparently involved in these crimes.
Investigators confirmed that on multiple dates in January 2015, the accused distributed child pornography in the parish of LaSalle.
On Wednesday, March 18, 2015, when officers executed the search warrant, they located numerous electronic devices. During a forensic preview of the machines belonging to the accused, investigators located and viewed over 100 images and videos of child pornography.
Jeansonne was placed under arrest and booked into the LaSalle Parish Jail on 100 counts of pornography involving juveniles (possession), and six counts of pornography involving juveniles (distribution).
The suspect was later transferred to the LaSalle Correctional Center where he was held until he was recently ordered released.
